When I reported this to Marriott Corporate, a supervisor named Robin agreed on a recorded line that the situation was "disturbing." Rather than receiving professional remediation, I was met with immediate hostility and retaliation by the on-site manager, Anthony. 2. Retaliatory & Illegal "Self-Help" Eviction (RPAPL § 853) After I exposed the sanitary condition of the room, Anthony performed an illegal "self-help" eviction. Because my stay exceeded 30 consecutive days, I had established legal residency. Under New York law, a 30-day occupant cannot be removed without a court-ordered warrant of eviction. • The Lockout: At 2:00 PM—while my insurance had already paid for the night—Anthony disabled my room keys, barring me from my belongings and my medically fragile pet. • The Coercion: He utilized the threat of police intervention to intimidate me into vacating by 4:00 PM. • The Legal Penalty: Under RPAPL § 853, an unlawful removal entitles the victim to TRIPLE (TREBLE) DAMAGES. 3. Verifiable Financial and Property Loss The hotel’s retaliatory actions resulted in severe damages: • Professional Income Loss: The disruption caused by the illegal lockout resulted in $3,500 in lost income that evening. Under the 3x statutory multiplier, the property’s liability for this loss alone is $10,500. • Property Damage & Loss: In the coerced, high-stress rush to vacate under threat of arrest, high-value designer items and jewelry were either lost or permanently damaged. • Pet Endangerment: My cat, who has cancer and asthma, was trapped inside the room during the lockout, creating a life-threatening situation. Final Verdict This management team chose to retaliate against a guest and endanger a sick pet rather than address a stomach-churning health violation that their own corporate supervisor described as "disturbing." This property's illegal conduct and sanitary violations have been officially documented as part of my formal grievance with the New York Department of Financial Services (DFS). and I am pursuing all legal avenues to recover the statutory triple damages caused by this unlawful eviction.
